Due to the evolution of the Covid-19 Pandemic in Brazil, all administrative procedures deadlines of trademarks, patents, industrial design and technology transfer agreements, will remain suspended until April 30, 2020, as established by the new Resolution number 161, of BPTO – Brazilian Patent and Trademark Office, published on April 14, 2020.
The suspension of the deadlines by the BPTO generate two different situations (for counting deadlines purpose):
- The deadlines that were already in course between March 16, 2020 (first day of the suspension) and April 30, 2020, will flow again at the end of the suspension period for the remaining time. In this case, the counting of the deadline will be resumed from when it had stopped.
- The deadlines that would have begun during the suspension will start being counted after the end of the suspension.
Note: Kindly note that despite the suspension, it is still possible to file petitions, requests and application before the BPTO, through their online system. Therefore, the use of the deadline suspension is optional.
